The temporary employment sponsored visa or 457 visa as it is more commonly known, is used by employers to sponsor and employ skilled overseas workers to work in Australia on a temporary basis. There are also special arrangements for employers in regional areas across Australia.

Employers can be either:

  • Australian businesses
  • Overseas businesses.

This visa will allow an employer to employ overseas workers for a period of between three (3) months and four (4) years. It will also allow the employee to bring any immediate family such as spouse and dependent children with them on the same visa, with full work and study rights. Dependent children are classed as those under 18, or under 25 providing they are still in full time education and not married. The employee and family after arriving in Australia can then enter or leave Australia as many times as required during the validity of the visa.

The 457 employment sponsorship consists of 3 parts (Click the title for further information):

  1. Sponsorship - The sponsoring business must become an approved sponsor. Being an approved sponsor allows the company to employ any number of skilled people from overseas. This sponsorship is valid for 2 years.
  2. Nomination - This allows the sponsoring company to nominate the position (occupation) they want to fill with a skilled overseas employee. This can be for any number of employees in this position, but it must be currently on the list of skilled occupations specified by the department of immigration. For example a car repair company may nominate 3 mechanic positions or just 1 to fill by overseas employees. This nomination is valid for 12 months.
  3. Visa - The final stage is the visa application for each of the nominated employees.

Renewing of the visa:

It is possible to renew this visa, but the employee must lodge a new visa application ideally before the old one expires. The new employer must also lodge a new sponsorship and/or nomination if valid sponsorship or nomination does not already exist.
